Cancellations 3+ days before your tour incur a 15% fee. Cancellations within 48 hours, on the day, or no-shows receive no refund. Quadbike routes and itineraries may change due to weather, safety or access conditions. Unsafe or intoxicated behaviour may result in removal from the tour with no refund. Participation involves inherent risks, and customers must sign a Waiver. Photos or video may be taken during the tour; please tell us if you do not want your images used. Full Terms & Conditions Effective 1 March 2023 (revised 1 December 2025) These Terms & Conditions apply to all bookings with Kalbarri Quadbike Safaris (“we”, “us”, “our”). By making a booking, you agree to these Terms & Conditions for yourself and all participants in your group. 1. General 1.1 These Terms apply to all bookings made with us, whether directly or through a third party. 1.2 By booking, you confirm that you and all participants accept these Terms & Conditions. 2. Definitions Activity – any tour or experience provided by us. Booking – your reservation to participate in an Activity. Cost – the total price of the Activity. Deposit – a non-refundable, non-transferable payment made at the time of booking. Cancellation Fee – any fee payable when a booking is cancelled. Force Majeure Event – events outside our control (weather, natural disaster, government restrictions, pandemic, lack of access, etc.). Goods – any equipment or property supplied by us. Waiver – the Release, Indemnity and Acknowledgement form to be completed by participants. Provider / We / Us – E.M. Nightingale & M.L. Rodger t/as Kalbarri Quadbike Safaris. 3. Bookings 3.1 All bookings are subject to availability. 3.2 We may decline a booking at our discretion. 3.3 Unless agreed otherwise: Full payment is required at the time of booking. You must provide the names of all participants. Promotional packages may have different terms. 3.4 A valid credit card is required as security for the booking and may be charged for cancellations, damages or breaches of these Terms. 3.5 Failure to pay when due may result in cancellation of the booking. 3.6 If you pay by credit card, you confirm you are authorised to use that card. 4. Cancellation & Amendments 4.1 All cancellations must be submitted in writing. 4.2 If you cancel: 3 days or more before the Activity: 15% of the total Cost is retained. Within 48 hours, on the day, or no-shows: no refund is given. 4.3 Changes requested within 48 hours are treated as cancellations. 4.4 We may rebook your space after cancellation. 5. Costs 5.1 Prices are in AUD and include GST. 5.2 Prices may change at any time but not for fully paid bookings. 6. Changes to the Activity 6.1 Outdoor quadbike Activities require flexibility. Weather, track conditions or safety issues may cause changes. 6.2 We may: change or modify routes or itineraries substitute an alternative experience delay, postpone or cancel a tour 6.3 No refunds or compensation apply for changes due to circumstances beyond our control. 7. Use of Equipment 7.1 All equipment remains our property. 7.2 You must not alter or misuse equipment. 7.3 You are responsible for ensuring the equipment suits your needs. 7.4 You are liable for any damage you cause and must pay repair or replacement costs. 7.5 Equipment must be returned in good condition (fair wear and tear excepted). 7.6 We may inspect equipment at any time. 8. Behaviour Policy 8.1 Intoxication, unsafe behaviour or disruption to others will not be tolerated. 8.2 If a tour is terminated due to such behaviour, no refund is given. 9. Your Warranties You agree that: (a) You will follow all laws and instructions. (b) You understand the Activity involves inherent risks, including risk of injury or death. (c) You accept all such risks and release us from related claims. (d) You will report hazards immediately. 10. Termination 10.1 We may cancel your booking immediately if you breach these Terms. 10.2 If terminated due to your breach, all money paid is forfeited. 10.3 Our rights prior to termination continue to apply. 11. Waiver of Liability 11.1 These Terms form a binding agreement. 11.2 To the extent permitted by law, we exclude liability for personal injury or death resulting from participation. 11.3 You voluntarily sign the Waiver knowing you may decline to participate. 11.4 You release and indemnify us and our staff from claims relating to injury or death arising from participation. Parent/Guardian: You accept these acknowledgements on behalf of your child. 12. GST All prices include GST unless stated otherwise. 13. Insurance You must arrange your own travel and medical insurance covering medical costs, evacuation, trip cancellation and force majeure impacts. 14. Force Majeure If a Force Majeure Event occurs: It is not a breach of contract No compensation is payable We will aim to minimise disruption We may at our discretion: substitute an alternative Activity postpone, delay, or cancel the tour offer a transfer to another date within 24 months offer a credit valid for 24 months (conditions apply) 15. Personal Information & Images 15.1 We may use your personal information for purposes related to your booking, in line with the Privacy Act 1988 (Cth). 15.2 Photos or video may be taken during your Activity. These may be used for promotional purposes such as our website or social media. If you do not want your image used, please let us know at the time of your tour or contact us in writing. 16. Severability If any part of these Terms is invalid, the rest remains in effect. 17. Governing Law These Terms are governed by the laws of Western Australia.
